Attorneys specializing in state election law believe the statute has never been prosecuted. Jeenah Moon-Pool/Getty ImagesTwo highly respected law professors specializing in New York election law said the same. "I think it's very smart of prosecutors to use this state law, whether it's been used before or not," said Jeffrey M. Wice, who teaches state election law at New York Law School. Related storiesThese same three "underlying crimes" — using state election law, federal election law, and state tax law — were again given equal prominence here in a February 15 decision by Merchan. "You're having an underlying crime within an underlying crime to get to that felony," Connor told BI.

Former US President Donald Trump speaks to members of the media at Manhattan criminal court in New York, US, on Thursday, April 25, 2024. The plans, which the Journal report described as highly secretive, are part of a 10-page document that suggests Trump — if elected — would be consulted on interest rate decisions. Along with those proposals, the draft contends that Trump could remove current Fed Chair Jerome Powell from office and require that Fed policy be aligned with the administration's goals. While in office, Trump harshly criticized Powell and his fellow central bankers as they were raising interest rates and reportedly considered ousting him. Trump campaign officials told the Journal that the draft proposals shouldn't be considered "official."

In front of television cameras and a gaggle of journalists, former President Donald Trump wished his wife, Melania Trump, a very happy birthday Friday morning, moments before he entered the courtroom for his criminal hush-money trial. "I want to start by wishing my wife Melania a very happy birthday," he told reporters in the downtown Manhattan courthouse hallway. Trump is spending the day in Manhattan's criminal court, where he's on trial for charges alleging that he falsified business documents to disguise payments to porn star Stormy Daniels. AdvertisementTrump did not address why Melania Trump, or any of his other family members, have not attended the trial to support him. Trump said he listened to the arguments Thursday night, after his court day in Manhattan, and "thought it was really great."

Prosecutors have framed the trial as more than a simple case of falsifying business records — the offense with which Trump has been charged. But the results of Trump’s pending cases — and whether they even come to trial — could help decide the tone of a future presidency. But at the same time, Trump is using the privileges of appeals available to any defendant to their full extent. “We’re writing a rule for the ages.”It’s always hazardous to speculate how Supreme Court justices will rule based on their questioning in oral arguments. This could mean the case returns to lower courts for more litigation — a move that could delay the federal election trial for months, far beyond the November election.

PinnedNew York’s highest court on Thursday overturned Harvey Weinstein’s 2020 conviction on felony sex crime charges, a stunning reversal in the foundational case of the #MeToo era. Citing that decision and others it identified as errors, the appeals court determined that Mr. Weinstein, who as a movie producer had been one of the most powerful men in Hollywood, had not received a fair trial. The four judges in the majority wrote that Mr. Weinstein was not tried solely on the crimes he was charged with, but instead for much of his past behavior. It was not immediately clear on Thursday morning how the decision would affect Mr. Weinstein, 71, who is being held in an upstate prison in Rome, N.Y. Mr. Weinstein was accused of sexual misconduct by more than 100 women; in New York he was convicted of assaulting two of them.

A recurring theme in the testimony of David Pecker, the former publisher of The National Enquirer, has been how people around Donald J. Trump lived in fear of his wrath. Notably, Mr. Pecker kept his eyes locked on exhibits and prosecutors while discussing Mr. Trump’s temper, not once glancing over at the former president in the courtroom. Mr. Trump appeared subdued during Mr. Pecker’s testimony, as he has for most of the trial, but at one point, he motioned to the lawyers next to him and crossed his arms over his chest. Mr. Pecker and Mr. Cohen were in frequent contact during the 2016 presidential campaign, strategizing over how to bury threatening news about Mr. Trump before the November election. In urging Mr. Pecker to kill harmful stories, Mr. Cohen often invoked Mr. Trump’s potential anger as a reason for Mr. Pecker to do what he asked.

But on Tuesday, former National Enquirer boss David Pecker lifted the curtain on the actual media collusion that took place in the 2016 election. Pecker revealed in granular detail how Trump worked hand-in-hand with the infamous national tabloid to boost his candidacy and, perhaps far more importantly, simultaneously smear his political opponents with shameful lies and innuendo. Meanwhile, Pecker worked with Cohen to smear Trump’s Republican rivals in the 2016 primary, including Ben Carson, Ted Cruz, and Marco Rubio. At times, Pecker said that Cohen went as far as to contact him and direct the Enquirer to attack Trump’s GOP rivals. When the Enquirer published negative stories about Bill and Hillary Clinton, Pecker said that Trump was elated.

Arizona took a major step on Wednesday toward scrapping an 1864 law banning abortion, when three Republican lawmakers in the state House of Representatives broke ranks with their party and voted with Democrats to repeal the ban. Republican leaders had thwarted earlier repeal efforts in the two weeks since the Arizona Supreme Court ignited a political firestorm by reviving the Civil War-era law, which outlaws abortions from the moment of conception except to save the mother’s life. “The people of Arizona are waiting for us to get this done,” said Rep. Stephanie Stahl Hamilton, a Democrat, who introduced the one-sentence bill to undo the 1864 law. Many voters denounced the ban — which provides no exceptions for cases of rape or incest — as a draconian intrusion into women’s rights. And some Republicans — including former President Donald J. Trump — said they wanted the Legislature to scrap it quickly, to try to head off a possible election-year backlash.

Read previewUS President Joe Biden last week called for a tripling of tariffs on Chinese steel and aluminum imports, echoing former President Donald Trump's levies on a range of goods from China. Biden — who is the frontrunner for the Democratic Party's presidential nominee — said China's steel production was backed by state funds, which enable the commodity to be sold cheaply to the US. He wants to hike a key tariff on Chinese steel and aluminum from 7.5% to 25%. AdvertisementHowever, the US isn't a large Chinese steel importer. AdvertisementLin added that China's steel sector is geared toward meeting domestic demand and doesn't receive any export-oriented subsidies.

The U.S. Secret Service is in the business of protecting the president, whether he’s inside the Oval Office or visiting a foreign war zone. But protecting a former president in prison? That would be the challenge if Donald J. Trump — whom the agency is required by law to protect around the clock — is convicted at his criminal trial in Manhattan and sentenced to serve time. Even before the trial’s opening statements, the Secret Service was in some measure planning for the extraordinary possibility of a former president behind bars. Prosecutors had asked the judge in the case to remind Mr. Trump that attacks on witnesses and jurors could land him in jail even before a verdict is rendered.

Danilewitz said Trump's defense team may have a different strategy in mind when it comes to Melania Trump. If Trump's family does decide to show up Monday, they might want to wear sweaters.

CNN —Republican Speaker Mike Johnson showed political courage that is rare in Washington and notable legislative skill for an inexperienced leader in forcing a long-delayed $60 billion aid bill for Ukraine through the House of Representatives on Saturday. And 112 Republicans — a majority of the conference — voted against the Ukraine bill. And any Republican speaker propped up by Democrats might hemorrhage support among GOP lawmakers and be forced to resign. “As we deliberate on this vote, you have to ask yourself this question: Am I Chamberlain or Churchill?” he said. The accidental speaker makes an unlikely Churchill, but on Saturday he proved to be a far more daring and substantial figure than many of his Republican and Democratic critics previously believed.

The case — brought by Alvin Bragg, the Manhattan district attorney, against Mr. Trump — represents the first time in our nation’s history that a former president is a defendant in a criminal trial. As such, it has generated lots of debate about the case’s legal strength and integrity, as well as its potential impact on Mr. Trump’s efforts to win back the White House. A review of thousands of cases in New York that charged the same felony suggests something striking: If Mr. Trump is found guilty, incarceration is an actual possibility. It’s not certain, of course, but it is plausible. Jury selection has begun, and it’s not too soon to talk about what the possibility of a sentence, including a prison sentence, would look like for Mr. Trump, for the election and for the country — including what would happen if he is re-elected.

Right now, I feel closer to Donald J. Trump than I ever have before. That's because Trump looks like he's having trouble staying awake at his first-ever criminal trial. I don't know how long I was out for — probably just a few seconds — but definitely long enough for them to notice, and for me to notice that they noticed. I don't know when Donald Trump goes to sleep, but I do know that during his Twitter era, he tended to do a lot of late-night scrolling — also relatable — and posting. So don't worry about the nap-shaming, Mr. Trump — many of us do the same thing.

The United States, unlike democracies that have been historically less stable, is not a nation accustomed to seeing its former heads of state on trial. This is one reason why Trump’s 2024 campaign is running as much through the courtrooms as according to the traditional rhythms of a White House bid. It’s very unfair that I’m having a trial there,” Trump said on Friday, alluding to New York City’s liberal lean. The deteriorating situation could bolster Trump’s claims the world is spinning out of control under his successor’s watch. Opinion: The world rushes to court Trump

She is a weekly opinion contributor to CNN, a contributing columnist to The Washington Post and a columnist for World Politics Review. Now, they’re urgently working on two fronts: seeking to Trump-proof their foreign policy and defense, and hoping to minimize the potential negative impact of a Trump victory. Making matters more unusual – and far more unethical – Trump has effectively launched his own shadow foreign policy, actively undermining Biden’s – America’s – policy. Not only is the former president leveraging his control of the Republican Party to block US aid to Ukraine ‑ Trump is interfering in US foreign policy elsewhere. Interfering in US foreign policy is bad enough, but there’s also an unseemly financial angle.

The stolen election falsehood that dominates the GOPJohnson’s willingness to lend the authority of his office to Trump’s “election integrity” campaign shows how Trump’s stolen election conspiracy theory has consumed almost every pillar of power in the GOP. Trump and Johnson are also expected to relitigate the 2020 election during Friday’s press conference, a Trump adviser told CNN. “IT’S SO THEY CAN VOTE, VOTE, VOTE,” Trump said on his Truth Social network in December. Two days after the election, Trump declared, “If you count the legal votes, I easily win. “I support President Trump, I’m one of his biggest fighters here in Congress.

A few weeks ago, Mike Pence did what no other vice president in the modern era has done: He refused to endorse the re-election of the president under whom he served. When it comes to alumni of Donald Trump’s administration, Mr. Pence is hardly alone; the list of high-ranking officials who worked for Mr. Trump and have implied or outright stated that they can’t support their former boss under any circumstances has grown to an astonishing length. The list of prominent Republican figures who did not serve under Mr. Trump and who regard him as unacceptable is equally impressive. More than a fifth of voters in the Republican primaries supported Nikki Haley, a former governor of South Carolina; among many of them, there is intense opposition to Mr. Trump’s presidential run. So two things are happening at once: The Republican Party is thoroughly MAGA and will be for the foreseeable future, and there is a small but influential number of Republicans who are deeply opposed to what their party has become but not prepared to shed their political identity and join the Democrats.
